Memes live in a beautiful legal grey zone. Almost everyone remixes, reposts and recaptions almost everything, and nobody gets sued for a joke sent in a group chat. The moment the same image touches money — a product, an ad, a shop — the grey zone ends quickly. This article is not legal advice and your country's rules differ, but the practical line between "fine" and "risky" is drawn in roughly the same place everywhere: what you do with the image, not whether you made it. Read this before you put a viral picture on a sticker, a mug or an ad.
Personal sharing versus commercial use
The single most useful question is: "Am I making money from this?" If the answer is no — you are joking in a chat, posting to your own feed for fun, or mocking something in a satire account — most legal systems give you room. US fair use considers purpose, nature of the work, amount used and market effect; commentary and parody are explicitly mentioned as allowed. UK and European law use similar "fair dealing" limits, mostly for criticism and review. None of this is absolute, but it is the environment in which meme culture grew up.
Now flip the answer to yes. Selling stickers, running a meme page with ad revenue, using a viral image in a brand campaign, printing it on t-shirts — that is commercial use, and the default rule changes to: you need permission from the copyright owner. The same image that was invisible to lawyers in a group chat becomes a lawsuit waiting to happen on a product listing. Brands get it wrong constantly, which is why self-made, abstract and original designs are the only safe basis for merch — see our guide to printable stickers for the workflow.
Who actually owns a template
A meme has two layers, and they have different owners. The format — the two-panel contrast, the calmly burning room, the top-and-bottom caption structure — is not copyrightable. It is an idea, a grammar, a sentence pattern; nobody owns "setup then punchline". The actual image is different. The photograph, the film still, the painting or the original artwork is owned by its creator, and cropping it, adding text to it, or recoloring it does not create a new copyright for you. Remix is a separate, often smaller, copyright held by the remixer, but it does not erase the original's rights.
Practical consequence: you can build your own version of a classic layout — a drawn character, a studio photo, an abstract split panel — and use it freely. What you cannot do is lift the famous photograph itself. This is exactly why our Meme Template Library ships self-drawn abstract versions of classic layouts instead of the viral originals: the grammar, without the copyright baggage.
What the platforms add on top
Platform rules are stricter than law in two directions at once. Instagram, TikTok and Discord all honor takedown requests quickly under their local versions of notice-and-takedown (DMCA in the US). If a rights holder files a claim, the post comes down fast — the platform does not want to argue fair use for you. At the same time, community guidelines separately forbid harassment, impersonation and non-consensual use of a person's face. So even an image you could argue is legal can get removed for platform policy. Read the uploader's terms before you build a whole content strategy on reposting: most platforms treat reposted viral images as the first thing they are willing to delete.
Credit, etiquette and the unwritten rules
Credit is not a legal magic shield — crediting a copyright infringer does not make it legal. But it is the social contract that keeps meme culture functioning. When you know who made the original image, tag them. When someone reposts your work and strips your name, that is the culture's worst sin. A few simple norms:
- Tag when you know — one tag costs nothing and keeps the creator in the loop.
- Do not claim the image as your own — even in a caption like "my new original meme" built on someone's photo.
- Ask before selling — if you want to print a viral image on merch, ask the creator first; many sell licenses cheaply or say no politely.
- Leave people out — using a real stranger's face in a punchline is harassment territory, not parody territory.
If someone steals your meme
Order matters. First, save evidence: your original post URL, the timestamp, and a screenshot. Second, send a polite message asking for credit — most reposts are thoughtlessness, not malice, and a tag is what people actually want. Third, if the use is commercial (they are selling it, running ads on it), file a formal takedown: on Instagram/TikTok/YouTube use their copyright complaint forms; for Google search results use the DMCA process; for hosting providers you use the same notice to their host. Keep claims narrow — one image, one post — because over-broad claims get rejected. And be ready for the mirror: when you build your own work with the Classic Meme Maker or Transparent Sticker Maker from your own photos, you hold the copyright cleanly, and this whole process becomes available to you instead of being done to you.
Is making a meme from a photo I found online legal?
Personal, non-commercial sharing is widely treated as parody or fair dealing in many countries, but it is not automatically legal everywhere. Once you sell merch, run ads or put the image on a product, you are in commercial territory and usually need permission from the copyright owner.
Who owns a meme template?
The photographer or creator of the original image typically owns the copyright in the image itself. Anyone is free to use the abstract format or grammar, but reusing the actual photograph or famous artwork without a license is the risky part.
Do I need to credit the original creator?
Credit is not usually a legal shield, but it is basic etiquette. Tag the original creator when you know who they are, and never claim someone else's image as your own. On platforms where reposts are expected, credit keeps you from being called out.
What can I do if someone steals my meme?
Start with a polite message asking for credit. If it is commercial, send a takedown notice under the platform process (for example a DMCA notice to Google, Instagram or Discord), keep evidence of your original post, and escalate only if the content is clearly yours.
Can brands use memes in advertising?
Brands can use self-made or licensed memes, but borrowing a viral photo or character for an ad is where lawsuits start. Safest practice: shoot your own original photos or use abstract templates, and keep the joke generic enough that it needs no recognizable third-party asset.
